What’s the Problem?

This recall affects Tiffin Bus and Tiffin Phaeton Motorhomes from model year 2020, according to the U.S. National Highway Traffic Safety Administration (NHTSA).

The steering pinch bolts on affected Tiffin Motorhomes may not have been properly tightened, NHTSA said.

A loose steering pinch bolt can result in a loss of steering control, increasing the risk of a crash.

Tiffin Inc. is notifying owners and dealers will tighten the steering bolts to specification, free of charge.

This recall began on August 27, 2020.

Peterson v. Tiffin Motor Homes

On November 20, 2017, Michael Peterson, a resident of Pennsylvania, filed a class action lawsuit against Tiffin Motor Homes, Inc., alleging breach of warranty over a Tiffin Motor Home that Peterson had purchased from Colton Auto RV in North Tonawanda, New York.

After purchasing the motor home on September 29, 2016, Peterson stayed in the RV at the Dealer’s location for the night but complained to the Dealer the next morning that the RV’s heat and hot water systems were not working at all, and that the headlights were malfunctioning.

Peterson left the RV with the dealer while repairs were made, but 9 days after picking up the RV and returning to Erie, there were several malfunctions with the vehicle’s electrical system including headlights, interior lights, bedroom lights, the radio, and the dashboard USB, along with woodwork fit and finishing defects, and the awning did not properly close.

On Nov. 16, 2016, the Dealer picked up the motor home from Peterson’s house to make the necessary repairs, returning the repaired RV on March 9, 2017. Peterson continued to have problems with the RV, including on July 1, 2017, when jacks would not properly level the RV and the alarm would not shut off, and September 2, 2017, when the engine overheated and the RV broke down on the side of the highway in New York.

After the breakdown, the RV was again returned to the Dealer but on September 23, 2017, the Dealer advised Peterson the parts ordered to repair the RV had yet to arrive. In Nov. 2017, the Dealer advised the RV was repaired and ready for Peterson to pick up, but in his conversation with the Dealer, Peterson realized all the repairs had not been made, and the Dealer responded they would contact Defendant to get any necessary parts.

Peterson filed the class action asserting 3 claims seeking relief under New York General Business Law (“N.Y. Gen. Bus. Law) § 198-a(n)(6) and (8) (“New York’s Lemon Law” or “the Lemon Law”), Complaint, First Claim (“Lemon Law Claim”); the Magnuson-Moss Warranty Act, 15 U.S.C. §§ 2301 et seq., Complaint, Second Claim (“Warranty Act Claim”); and N.Y. Gen. Bus. Law §§ 349-c through 350-f, Complaint, Third Claim (“Deceptive Practices Claim”).
