FDA Recall: Distraction System May Reverse Directions After Surgery

On August 28, 2014, the U.S. Food & Drug Administration (FDA) announced a Class I Recall [1] for the DePuy Synthes Craniomaxillofacial (CMF) Distraction System (AB Distractor Bodies and BC Distractor Bodies). Certain lots of this device [2], which is also called an External Mandibular Fixator And/Or Distractor and a Bone Plate, are being recalled because they may reverse direction and lose the desired distraction distance after surgery. When this occurs, it may result in:

  • Tracheal Obstruction
  • Respiratory Arrest
  • Death

Infants are at greatest risk if the distraction system fails because sudden obstruction of the trachea can occur. This may cause respiratory arrest which could lead to death. Children or adults who are able to maintain an open airway are at less risk because failure of the implant would not obstruct the trachea and could be reversible. In all patients, however, failure of the distraction system may require surgery to replace the device.

What is the CMF Distraction System?

The DePuy Craniomaxillofacial Distraction System is an implant used to lengthen and/or stabilize the lower jawbone and side of the lower jaw. This implant is used to correct congenital birth or post-traumatic defects of the jaw by gradually lengthening the bone.

Most cases involving medical devices allege that a product was sold with design, manufacturing, and/or marketing defects, which typically refers to a company’s failure to warn of a certain complication. In the case of the Craniomaxillofacial Distraction System, our attorneys suspect that patients may be able to take legal action in light of claims that DePuy Synthes failed to adequately warn doctors and patients about the risk of tracheal obstruction, respiratory arrest and death.
