What is an Ignition Interlock Device (IID)?
An ignition interlock device (IID) is a handheld device connected to a vehicle’s ignition system that measures the driver’s breath alcohol concentration (BAC) [1.].
It is commonly required for drivers convicted of DUI, DWI, or similar offenses, as it prevents the vehicle from starting if the driver’s BAC exceeds a preset limit.
“In simplest terms, an interlock device, or car breathalyzer, is an in-car monitor that prevents a user from starting a vehicle until a breath alcohol test is taken. An ignition interlock device is a proper term for devices sometimes referred to as a “car interlock” or “blow and go.”
How Does an Ignition Interlock Work?
The IID requires the driver to blow into the device before starting the vehicle. If the breath test shows a BAC over the preset limit, the vehicle will not start. If the BAC is below the limit, the car will start. The device must be regularly serviced and calibrated at an authorized service center, typically every 30, 60, or 90 days, depending on state regulations.
When You Will Be Required to Have an Ignition Interlock Device in Colorado
If You Were Arrested for DUI Before January 1, 2023:
1st Per Se or DUI Conviction:
- You may be eligible for early reinstatement after one month of revocation.
- If your BAC was above 0.15, a 2-year interlock requirement applies.
- With a lower BAC, an 8-month interlock requirement may apply.
1st Per Se with a Separate Driving Restraint:
- Early reinstatement may be possible after either an 8-month interlock requirement (2 years for PDD designation) or after the longest restraint period, subject to Department approval.
2nd or Subsequent Per Se Convictions:
- A 2-year interlock requirement is mandatory.
- Early reinstatement may be possible after serving one month of the revocation.
If You Were Arrested for DUI On or After January 1, 2023:
1st Per Se or DUI Conviction:
- Early reinstatement may be possible on the first day the revocation becomes active.
- With a BAC above 0.15, a 2-year interlock requirement applies.
- With a BAC below 0.149, a 9-month interlock requirement applies, running concurrently with the revocation period.
1st Per Se with a Separate Driving Restraint:
- Early reinstatement may be possible after either a 9-month interlock requirement (2 years for PDD designation) or after the longest restraint period, subject to Department approval.
2nd or Subsequent Per Se Convictions:
A 2-year interlock requirement is mandatory.
Early reinstatement may be possible on the first day the action becomes active.
If You Refused Chemical Testing:
Automatic 2-Year Interlock Requirement:
Early reinstatement may be possible:
- 1st offense: After serving two months, with a 2-year interlock requirement.
- 2nd offense: After serving two months, with a 2-year interlock requirement.
- 3rd or subsequent offenses: After serving two months, with a 2-year interlock requirement.
Can I Remove an Ignition Interlock Device Early in Colorado?
“The most frequents question regarding ignition interlock devices is whether they can be removed early. The answer depends on why a person’s driver’s license was revoked” [2.].
For a first offense with a BAC between 0.08 and 0.15, early removal may be possible after four months of compliance.
However, if your BAC was 0.15 or higher, or if your license was revoked due to a refusal to submit to a breath test, early removal is not allowed, and you must maintain the IID for two years.
If you have a prior DUI-related conviction, you are also required to maintain the IID for two years with no option for early removal. Additionally, court convictions can result in license revocations and interlock requirements, but the outcome of a DMV hearing may take precedence over court decisions regarding IID requirements.
