What’s the Problem?
May 1, 2017 – Atrium first introduced C-QUR mesh in 2005 via the U.S. Food & Drug Administration’s 510(k) approval process, which clears products that are “substantially equivalent” to products already on the market. Despite warnings of potential problems with the C-QUR design, Atrium distributed a long line of mesh devices for use in hernia repair, chest wall reconstruction and treatment of traumatic or surgical wounds. These products include:
• Atrium C-Qur Mesh
• Atrium C-Qur Mosaic
• Atrium C-Qur TacShield
• Atrium C-Qur V-Patch
• Atrium C-Qur Centrifx
• Atrium C-Qur FX Mesh (formerly C-Qur Lite)
Plaintiffs in the MDL allege that Atrium C-Qur mesh has a fish oil coating that produces an allergic reaction which can lead to severe health complications. Additionally, if the hernia patch adheres to the bowel, it could lead to the bowel becoming twisted or perforated, causing gastric ulcers or other adverse intestinal problems, according to the lawsuits.
Plaintiffs further allege that Atrium Medical knew or should have known about the potential risk of these side effects, but that it withheld this information from the public and medical community in an effort to maximize profits. The manufacturer has also been accused of issuing multiple “stealth recalls” for C-Qur mesh products that had high complication rates instead of recalling the devices or even notifying doctors or patients.
