What’s the Problem?

July 11, 2017 – The lawsuit involves a woman who claims that she developed ovarian cancer as a result of using Johnson’s Baby Powder and Shower-to-Shower.

So far, the talcum powder litigation has taken place in St. Louis, Missouri. A total of 5 cases have gone to verdict, with 4 in favor of plaintiffs and one in favor of J&J.

However, 2 rulings last month by the U.S. Supreme Court placed many such claims filed in Missouri in jeopardy since the plaintiffs do not reside in that state. Many legal analysts believe that California may be the next hotbed for talcum powder lawsuits, as plaintiffs in these cases more commonly reside in California, which means that their cases are not at risk of being dismissed.

Plaintiffs allege that use of talc-based products for feminine hygiene caused them to develop ovarian cancer. The complaints further allege that J&J and its talc suppliers knew their products caused ovarian cancer, but failed to provide warning labels or issue recalls for their products.

Defendants claim that studies linking talc to ovarian cancer are based on discredited studies, and they note that numerous regulatory agencies have decided against requiring warnings on talc-containing products.

The California lawsuit is: Eva Echeverria v. Johnson & Johnson, number BC628228, in the Superior Court of California for Los Angeles County.
