What’s the Problem?
Primavera Nueva Inc. voluntarily recalled certain lots of its 4-count tamales because the products have the potential to be contaminated with Listeria monocytogenes. Listeria can cause serious and sometimes fatal infections in young children, frail or elderly people, and others with weakened immune systems.
Healthy individuals may experience short-term symptoms such as high fever, severe headache, stiffness, nausea, abdominal pain, and diarrhea. Listeria infection can also cause miscarriages and stillbirths among pregnant women.
Latest Updates
- January 07, 2026 – A voluntary recall was posted for select 4-count Primavera tamales due to the potential presence of Listeria monocytogenes (with the recall revised to include a seasonal Roasted Pumpkin & White Cheddar variety). [1]
Product & Usage Overview
This recall involves select lots of Primavera brand 4-count tamales produced between October 10, 2024 and October 10, 2025. The affected varieties include:
- Roasted Green Chile & Jack Cheese
- Black Bean Bonanza & Jack Cheese
- Butternut Squash w/ Roasted Green Chiles & Cheese
- BBQ Chipotle Bean & White Cheddar
- Mushroom Spinach & Salsa with Two Cheeses
- Roasted Green Chile
- Black Bean Bonanza
- Butternut Squash w/ Roasted Green Chiles
- Mushroom Spinach & Salsa
- Roasted Pumpkin & White Cheddar
No other Primavera Nueva products are affected.
Where and When the Recalled Tamales Were Distributed
The recalled tamales were distributed by Primavera Nueva Inc. to retail stores in California and Nevada.
How to Identify Affected Product
Consumers with tamales bearing date codes 10/22/2024 through 10/22/2025 should not consume the product and should discard it.
Illness Reports
No illnesses had been reported at the time of the recall announcement.
Corrective Actions Noted
The tamales were made with a frozen ingredient labeled “Not Ready to Eat. Must Be Thoroughly Cooked Before Eating.” An FDA inspection on October 10, 2025 found earlier production records did not consistently verify internal cooking temperatures needed to control potential biological hazards, including Listeria monocytogenes.
Enhanced cooking-temperature monitoring and verification were implemented beginning October 11, 2025.
What Consumers Should Do
If you have the affected tamales, do not eat them. Discard the product. If you believe you became ill after consuming the tamales—especially if you are pregnant, immunocompromised, or medically vulnerable—seek medical evaluation promptly and inform your provider about the potential Listeria exposure.

Legal Theories & Liability Grounds
Depending on the evidence, food-recall injury claims are commonly evaluated under legal theories such as:
- Product liability: allegations that the food product entered commerce in an unreasonably dangerous condition.
- Negligence: allegations involving reasonable care in production controls and food safety practices.
- Failure to warn: allegations regarding the adequacy and timing of risk communications (case-specific).
- Consumer protection claims: claims tied to labeling and representations (case-specific).
Statute of Limitations & Timing
Deadlines for filing food-related injury and consumer claims vary by state and may depend on when symptoms began and when the cause was reasonably discovered. Preserving packaging, receipts, and medical documentation early can materially affect the ability to evaluate and support a claim.
