More than 100 lawsuits alleging a severe brain condition known as idiopathic intracranial hypertension (IIH) from Bayer’s Mirena IUD have been consolidated for pretrial handling in the U.S. District Court of New York.

What’s the Problem?
April 26, 2017 – The lawsuits allege that levonorgestrel, a hormone released by the Mirena intrauterine device, can increase the risk for IIH, a neurological side effect that can cause irreversible brain damage, blindness and chronic migraine headaches. IIH is also referred to as pseudotumor cerebri (PTC) and benign intracranial hypertension (BIH).
In Manhattan, approximately 150 federal Mirena lawsuits will be consolidated as part of a multidistrict litigation (MDL), which will allow the complaints to be coordinated together for pre-trial handling. Forthcoming suits will also likely be sent to the U.S. District of New York in the coming weeks and months.
The honorable Judge Paul Engelmayer has been selected to preside over the centralized litigation, In re: Mirena IUS Levonorgestrel-Related Products Liability Litigation (No. II).
A small group of plaintiffs in Mirena lawsuits requested consolidation in early 2014, when only about 15 such complaints had been filed. This early petition was denied, with the U.S. Judicial Panel on Multidistrict Litigation (JPML) noting that informal coordination was preferable to formal centralization whenever possible.
However, the legal situation has changed since then, according to the JPML. The litigation has grown from 15 lawsuits in 2014 to around 150 claims today. Moreover, a significant number of different plaintiffs’ law firms, at least 20, have become involved.
