Do You Qualify for a Walk-Behind Leaf Blower Recall Class Action Lawsuit?

You may qualify to pursue a Walk-Behind Leaf Blower Recall Class Action Lawsuit (or a related individual product-liability claim) if one or more of the following apply:

  • You purchased a recalled DR walk-behind leaf vacuum or tow-behind leaf vacuum identified in the recall.
  • You experienced an ejection event consistent with the hazard described in the recall (loose pieces ejecting or debris/material ejecting through the chute).
  • You suffered a laceration injury or incurred documented losses such as medical expenses, lost income, or other measurable damages tied to the incident.
  • You have documentation linking the specific model and the incident (purchase records, photos, service documentation, or witness information).

Evidence You Should Gather

  • Proof of purchase (receipt, invoice, order confirmation).
  • Photos of the unit, including “DR” on the motor housing and the model number location (walk-behind: front right side behind the wheel; tow-behind: impeller housing beside the engine).
  • Photos of the chute area and any damage consistent with the hazard.
  • Medical records and itemized bills if an injury occurred.
  • Any communications with DR Power about the repair kit and remedy status.

Damages You Can Recover

Recoverable damages depend on state law and the facts of the incident, but may include:

  • Medical expenses: emergency care, stitches, surgery, follow-up treatment, and rehabilitation.
  • Lost wages: time missed from work and reduced earning capacity in serious injury cases.
  • Pain and suffering: physical pain, scarring, and emotional distress tied to the injury.
  • Out-of-pocket costs: travel, medical supplies, and other incident-related expenses.

Depending on the evidence, claims involving recalled outdoor power equipment may be evaluated under common product-liability frameworks such as:

  • Defective design or manufacture: allegations that the unit can eject material due to internal component issues or chute vulnerability during foreseeable use.
  • Strict product liability: claims that the product was unreasonably dangerous when sold.
  • Failure to warn: claims focused on the adequacy of safety warnings and instructions prior to recall remedies (case-specific).

Statute of Limitations & Timing

Deadlines for filing personal injury and product liability claims vary by state. If an incident occurred, preserving the equipment (including the chute components), documenting the model number, and maintaining repair-kit communications can be important to protecting potential claims.
