Zofran Lawsuit Filed in Oregon

An Oregon family has filed a lawsuit against the manufacturer of anti-nausea drug, Zofran, alleging that the drug taken during pregnancy is responsible for their son being born with a severe heart defect.

A family from Gold Hill, Oregon has filed a lawsuit against GlaxoSmithKline (GSK) alleging that the anti-nausea medication Zofran caused their son to be born with a rare, potentially life-threatening heart defect.

What’s the problem?

According to the lawsuit, plaintiff’s use of Zofran during pregnancy caused her unborn son to develop a severe congenital abnormality known as an atrioventricular septal defect (AVSD). This condition occurs when there are holes between chambers of the heart and the valves that control the flow of blood between these chambers are formed incorrectly, according to the Centers for Disease Control and Prevention (CDC).

As a result of his birth defect, the child was required to undergo open-heart surgery at the age of 5 months, according to the lawsuit.

Now 10 years old, the boy continues to require treatment from heart specialists. Doctors have said his ASVD “will never completely resolve,” according to his parents. They live with the fear that their son will require additional heart surgeries in the future.

While many Zofran lawsuits have been filed alleging heart defects, few have specified the rare atrioventricular septal defect, despite a Swedish study’s findings that babies exposed to Zofran were nearly 5 times more likely to be born with the condition.

The lawsuit was filed in the U.S. District Court of Oregon, Medford Division under case number 1:15-cv-01734-CL.
