A product liability lawsuit has been filed against GlaxoSmithKline (GSK) by a North Dakota couple whose son was allegedly born with “severe birth defects” after the mother took Zofran during pregnancy.

What’s the Problem?
According to the lawsuit, plaintiff took Zofran orally and via IV to treat the symptoms of morning sickness during her first trimester of pregnancy. Her son was born in 2007, and subsequently diagnosed with a number of kidney problems including:
- Kidney damage
- Born with 1 kidney
- Malformation of the vas deferens (duct that transports sperm from the testicle to the urethra)
- Absence of “connective kidney tissue”
In 2013, the child was in an accident that damaged his one remaining kidney so badly that it only functions at 38% capacity, according to the complaint. As a result of these problems, the boy’s doctors have recommended that he avoid all sporting activities, and because of his vas deferens malformation, he may not be able to have children in the future.
Like other Zofran lawsuits, the North Dakota complaint alleges that GSK:
- Knew or should have known about the risks of using Zofran during pregnancy;
- Failed to warn doctors and patients about the risks of fetal exposure to Zofran, and
- Promoted the drug off-label, for purposes which the drug had not been approved for.
The mother in the North Dakota case claims that had she known about the risks involved with using Zofran for morning sickness, and had GSK disclosed this information, she would’ve never taken it and her son wouldn’t have been born with severe kidney birth defects.
