A Kentucky woman has filed a lawsuit against GlaxoSmithKline (GSK) alleging that her use of Zofran during pregnancy caused her son to be born with severe heart defects that ultimately led to his death.

What’s the problem?
According to the lawsuit, plaintiff was prescribed ondansetron — the generic version of Zofran — for morning sickness during her first trimester of pregnancy. The drug’s labeling merely stated that it should only be used when necessary during pregnancy, and that patients should discuss the potential risks and benefits with their doctor.
Plaintiff’s son was born on April 7, 2012, and subsequently diagnosed with multiple heart defects including hypoplastic right heart syndrome (HRHS). Unfortunately, 8 days after his birth, the baby died from resulting complications.
The lawsuit raises multiple causes of action including negligence and wrongful death against GSK and the hospital for failing to ensure that generic drugs are the same as their brand name counterparts, and that their labeling is the same.
The complaint also alleges that GSK failed to conduct adequate testing or post-marketing surveillance of Zofran when used by pregnant women for morning sickness. Additionally, the company has been accused of covering up studies which questioned whether Zofran was safe to use in pregnancy, and of aggressively marketing the drug for “off-label” uses.
Damages Sought by Plaintiff
The Kentucky mother claims that had she been aware of the risks involved with taking Zofran during pregnancy, she would have chosen another drug with fewer side effects to treat her morning sickness. Plaintiff seeks compensatory damages for medical expenses, mental and emotional anguish, loss of enjoyment and familial relationship resulting from the child’s death, as well as punitive damages and attorneys fees.
Kentucky Couple Blames Zofran for Daughter’s Death from Heart, Kidney Defects
On August 5, another lawsuit was filed in Kentucky on behalf of a couple whose daughter was born with fatal heart and kidney defects after the mother took Zofran during pregnancy. The suit is unique in that it is the first to allege post-birth exposure to Zofran, since the family’s pediatrician prescribed the drug to the baby girl for vomiting shortly after she was born. The complaint was filed in the Pike County Circuit Court for the Commonwealth of Kentucky under case number 15-CI-784.
