Zofran Lawsuit Filed in Kansas

Kansas Mother Blames Anti-Nausea Drug for Daughter’s Heart Defect

According to the lawsuit, which was filed Nov. 11, 2015, in the U.S. District Court for the District of Kansas, plaintiff Samantha Brosseau took Zofran during her first trimester for the treatment of pregnancy-related morning sickness. She continued to take the medication as directed through her 3rd trimester. Her daughter, “K.C.”, was subsequently born with an atrial septal defect (ASD), a severe heart defect Brosseau blames on Zofran exposure, since neither she nor anyone in her family has a history of heart defects.

Plaintiff alleges that GSK failed to adequately warn about the risks associated with taking Zofran during pregnancy. Since Brosseau’s filing, all federal Zofran lawsuits have been consolidated in the District of Massachusetts, and it is expected that this case will be transferred there as well.

What is an Atrial Septal Defect?

An atrial septal defect is a hole in the wall that separates the top 2 chambers of the heart. The defect allows oxygen-rich (red) blood to leak into the oxygen-poor (blue) blood chambers of the heart. Symptoms of an ASD include:

  • Irregular heart rate
  • Murmur or sensation of an abnormal heartbeat
  • Shortness of breath / pulmonary hypertension
  • Failure to thrive
  • Fatigue

Status of Zofran Lawsuits

In October, a panel of federal judges created a multidistrict litigation (MDL) for lawsuits alleging heart defects, cleft lip and cleft palate from Zofran. The cases will be overseen by U.S. District Judge Dennis Saylor, in the District of Massachusetts. There are currently more than 50 complaints included in the MDL.
