GlaxoSmithKline (GSK) has filed a petition with the U.S. Judicial Panel on Multidistrict Litigation (JPML) requesting consolidation of all Zofran birth defect lawsuits before one judge for pretrial discovery. All of the complaints involve similar allegations that GSK failed to warn doctors and patients of the risks Zofran poses to unborn children, and that the company marketed the drug “off-label” for morning sickness.

What’s the Problem?
The motion, which was filed July 6, requests the U.S. District Court for the Eastern District of Pennsylvania, which is located in Philadelphia, as the venue for the litigation, as this is the home of GSK’s headquarters in the U.S. As of August 15, at least 30 Zofran lawsuits filed alleging that the drug caused birth defects including:
Complaints have been filed in Arkansas, Ohio, Louisiana, Massachusetts, Texas, Montana, California and Minnesota. One of the lawsuits alleges that Zofran caused a woman to have a miscarriage.
Why was Consolidation Requested?
The request for consolidation is common in mass torts when a large number of lawsuits are filed involving similar allegations. If JPML grants the request, all federal Zofran lawsuits will be transferred to the chosen venue where the cases will be overseen by one judge. Consolidation is intended to reduce duplicative discovery, avoid conflicting rulings by different judges, and to streamline the litigation process.
Where will the Venue be?
GSK requested that the litigation take place in the U.S. District Court for the Eastern District of Pennsylvania, and that Judge Cynthia M. Rufe oversee the lawsuits, since she has experience managing multidistrict litigations (MDLs) involving prescription drugs that allegedly caused birth defects.
