A Tennessee woman who allegedly took Zofran during pregnancy and gave birth to a daughter with severe heart defects has filed a product liability lawsuit against the drug’s manufacturer, GlaxoSmithKline (GSK).

What’s the problem?
February 9, 2016 – According to allegations raised in the complaint, plaintiff began taking Zofran (generic: ondansetron) for morning sickness during her 1st trimester of pregnancy in August 1999. Her daughter was born in April 2000 and subsequently diagnosed with severe heart defects including pulmonary valve stenosis and atrial septal defect.
The mother alleges neither she nor anyone else in her family has a history of congenital heart defects. Furthermore, plaintiff says she had an earlier pregnancy in which she did not take Zofran and gave birth to a healthy baby girl.
“As a direct and proximate result of GSK’s conduct, Plaintiff and her daughter have suffered and incurred damages, including severe and permanent pain and suffering, mental anguish, medical expenses and other economic and non-economic damages, and will require more medical treatment than had they not been exposed to Zofran,” the complaint alleges.
The complaint was originally filed Jan. 19 in Kentucky state court under case #1:16-cv-10156-FDS, and subsequently transferred to the Zofran multidistrict litigation (MDL) in Boston. Plaintiff is seeking damages in excess of $75,000 from GSK for negligence, fraudulent misrepresentation and concealment, breach of warranty and strict products liability.
