What’s the Problem?
According to the complaint, Paul Ramirez and Dulce A. Morga’s daughter Sarah was born in late 2014 with severe congenital heart defects, including Epstein’s anomaly. Morga’s doctor noted that the baby had an extremely enlarged heart with an atrialized right ventricle that was not functioning.
As a result of these problems, Sarah was forced to undergo open heart surgery when she was just 5 days old. Sadly, she did not survive the trauma and died in her mother’s arms less than a week later.
The complaint was filed November 13 in federal court in the Central District of California, alleging claims of negligence, strict products liability, intentional misrepresentation, concealment, negligent misrepresentation, breach of warranty and violations of California law. Ramirez and Morga are seeking compensatory and punitive damages against GSK.
