Alabama Couple Alleges Zofran Caused Son’s Heart Defects

A couple in Alabama have filed a lawsuit alleging that the mother’s use of Zofran during pregnancy was related to multiple congenital heart defects that her son was born with.

A lawsuit recently filed in Alabama alleges that a mother’s ‘off-label’ use of Zofran during pregnancy caused her son to be born with multiple congenital heart defects.

What’s the problem?

According to the lawsuit, plaintiff was prescribed Zofran for pregnancy-related nausea in 2011, through an IV for the first 8 weeks and then in pill form for another month. Her son, referred to in court documents as ‘W.T.T.’, was born cyanotic (with a blue tint to his skin and lips caused by a lack of oxygen), which is almost always associated with a congenital heart defect.

It was subsequently determined that W.T.T. had 3 separate holes in his heart, including a large atrial septal defect (ASD). As a result of these problems, W.T.T. was transferred to a larger medical facility for treatment and observation for the next 2 months.

At the age of 4 years, the boy underwent surgery to repair his ASD, which measured 0.6 inches by 0.7 inches in size. This is the first of 40-odd Zofran heart defect lawsuits to specify the exact size hole in the patient’s heart.

Lawsuit Allegations

Plaintiff accuses drugmaker GlaxoSmithKline (GSK) of failing to warn of the risks associated with using Zofran during pregnancy. According to the lawsuit, “had GSK marketed Zofran in a truthful and non-misleading manner, [plaintiff] would never have taken Zofran.”

The complaint was filed September 8 in the U.S. District Court for the Northern District of Alabama, Southern Division, under case number 2:15-cv-01638-RDP.
