What’s the Problem?

According to the lawsuit, the mother was prescribed Zofran for morning sickness during her first and second trimesters of pregnancy. Her son was born in 2009 and subsequently diagnosed with a ventricular septal defect (VSD), a condition that occurs when there is a hole in the wall that separates the 2 lower chambers of the heart.

The complaint states that the child’s quality of life has been diminished because he has “experienced severe development delay, cannot run or play hard with other children, and has exhibited emotional challenges due to his injury that was caused by his mother’s ingestion of Zofran.”

According to the lawsuit, the mother has 2 other children that were born without defects, and that she did not take Zofran during either of those pregnancies. The complaint was filed in U.S. District Court of the Southern District of Illinois (case number 3:15-cv-00902).

Treatment

Small ventricular septal defects often close without the need for professional medical treatment. However, if the VSD is large, it may be treated either with prescription medications or with open heart surgery, which is usually performed during early childhood. The surgery consists of covering the hole with a patch, which eventually is covered by normal heart lining tissue. Small VSDs may be closed without a patch.
