Zofran Cleft Palate Lawsuit Filed in Mississippi

A Mississippi family has filed a lawsuit against GlaxoSmithKline (GSK) alleging that the company’s anti-nausea drug Zofran caused their daughter to be born with a cleft palate.

What’s the Problem?

According to the lawsuit, which was filed July 17 in U.S. District Court of the Southern District of Mississippi, Northern Division, plaintiff began taking Zofran for morning sickness during her first trimester of pregnancy. Her daughter, referred to in court records as C.P.T., was born in January 2015 and subsequently diagnosed with a soft cleft palate.

This condition occurs when there is a split of “cleft” in the soft, muscular portion of the roof of the mouth. The defect can affect feeding, breathing, speech and language development. C.P.T.’s parents claim they have no family history of oral cleft defects, and that their previous child — in which the mother did not take Zofran while pregnant — was born healthy and without congenital abnormalities.

Studies Find Link Between Zofran and Cleft Palate

The U.S. Food & Drug Administration (FDA) has only approved Zofran for the treatment of nausea and vomiting associated with cancer treatment and certain types of surgery; however, the medication is often prescribed “off-label” to pregnant women for morning sickness. When used for this purpose, Zofran has been linked to birth defects. In 2011, a study presented by researchers at Harvard and Boston University found a 2.37 times increased risk for cleft palate in babies who were exposed to Zofran’s active ingredient in the womb.

Cleft Palate Surgery

The goal of cleft palate surgery is to fix the roof of the mouth so that the child can eat and talk normally. According to The Children’s Hospital of Philadelphia, a number of different techniques may be used to repair the defect, such as a Z-plasty or a V-Y-pushback. These procedures close the palate in 3 layers: the inner layers that form the nasal lining; the middle layers consisting of the muscles at the back of the palate; and the final layer, which includes the oral mucosa. Surgical repair of the palate typically occurs around 1 year of age, before significant speech development begins.

Status of Zofran Litigation

The Mississippi case joins at least 34 others filed in federal courts alleging that Zofran caused birth defects. This number is expected to climb into the hundreds or even thousands as awareness of the drug’s dangers continues to grow. The Mississippi lawsuit is: case #5:15-cv-00070-DCB-MTP.
