What’s the Problem?

According to the lawsuit, which was filed April 3, the girl has undergone 10 surgeries since 1998 to repair her cleft palate. The complaint accuses GlaxoSmithKline (GSK) of illegally marketing Zofran “off-label” for the treatment of morning sickness, when the drug has never been approved for this purpose.

Additionally, the lawsuit alleges that GSK obtained data as far back as the 1980s which indicated that Zofran readily crosses the placental barrier in pregnant mammals, and that the company has been receiving reports of birth defects associated with the drug since at least 1992.

Because Zofran lacks appropriate warnings, the lawsuit contends that the girl’s parents were not aware until 2015 that the drug could cause cleft palate. Had the mother known the risks of using Zofran during pregnancy, she would’ve never taken it.

Facts about Cleft Palate

Cleft palate is an orofacial defect that occurs during the first trimester of pregnancy. Clefting occurs when there is not enough tissue in the mouth, and the tissue that is available does not join together properly in the womb. A cleft palate can involve the hard palate (the bony front portion of the roof of the mouth), and/or the soft palate (the soft back portion of the roof of the mouth).

Cleft palate is among the most common congenital defects reported in the U.S. The malformation occurs most often in children of Asian, Latino and Native American descent. Compared with girls, twice as many boys have a cleft lip, with or without a cleft palate. However, compared with boys, twice as many girls have cleft palate without a cleft lip.

GSK Fined $3B for Illegally Marketing Zofran

Zofran has never been approved to treat morning sickness, and the drug’s label states that it has not been well studied in pregnant woman. However, in 2012, GSK paid $3 billion to resolve charges with the Justice Department that it marketed Zofran as a treatment for morning sickness. Court documents alleged GSK gave doctors kickbacks to prescribe Zofran to pregnant women, and disseminated false information about the drug’s safety and effectiveness.
