A new lawsuit has been filed against GlaxoSmithKline (GSK) in the Philadelphia County Court of Common Pleas by a Missouri couple who claim their son was born with a cleft lip after the mother took Zofran during pregnancy.

What’s the problem?
According to the lawsuit, the mother was prescribed Zofran for morning sickness during her first trimester of pregnancy. Her son, referred to in court documents as “E.V.”, was born in 2006 and subsequently diagnosed with a cleft lip, an orofacial birth defect that occurs when there is a split in the upper part of the baby’s lip.
As a result of his defect, E.V. was forced to undergo surgery during infancy to close the cleft in his lip, according to the complaint. While the operation was considered a success, it left his mouth with visible scarring.
A second surgery was performed in 2012 to correct the appearance of E.V.’s lip; however, the family claims significant scarring remains visible from his upper lip into his nose. According to the lawsuit, the cartilage under the boy’s nose is still “malformed” and asymmetrical.
The complaint, which was removed to the U.S. District Court for the Eastern District of Pennsylvania on September 1, alleges that Zofran:
- was defectively designed
- was not adequately tested before being brought to market
- was illegally marketed
- lacked proper warnings
Zofran Cleft Defect Studies
The lawsuit references a number of epidemiological studies which identified links between Zofran use in pregnancy and birth defects. One of these studies, published in 2012 by researchers at Harvard and Boston Universities, found that expecting mothers who used Zofran during their 1st trimester were 2.37 times more likely to give birth to babies with cleft palate, a congenital defect that often accompanies cleft lip.
