What’s the problem?
February 12, 2016 – Of the 9 complaints, only 1 was originally transferred from another court. The other 8 were filed directly into the MDL last week. The litigation now includes at least 224 lawsuits, according to the court docket.
In the transferred case (#1:16-cv-10156-FDS), a Tennessee woman claims that her use of Zofran in pregnancy caused her daughter to be born with severe heart defects. The complaint was initially filed in a Kentucky state court on Jan. 19, 2016.
Judge F. Dennis Saylor IV announced in December that new Zofran birth defects lawsuits may be filed directly into the MDL, in a move intended to streamline the litigation. In one such case (#1:16-cv-10153-FDS), a woman from Virginia Beach claims she was prescribed Zofran in April 2013, approximately 13 weeks into her pregnancy. She underwent an ultrasound procedure in August, where it was determined that her unborn daughter had tetralogy of fallot, a rare cluster of severe heart defects. As a result of these problems, the child was forced to undergo open heart surgery only 3 months after being born.
Subsequent genetic testing was unable to determine a cause of the child’s defects, which suggests an environmental factor. It is only now, nearly 3 years after her daughter’s birth, that the plaintiff has become aware of multiple studies linking Zofran to an increased risk for congenital heart defects. She says that she would never have taken the drug had she known the risks beforehand.
