Two new lawsuits have been filed in Alabama federal court by women who allegedly had children with birth defects after they took the anti-nausea drug Zofran during pregnancy.

What’s the Problem?
Both new Alabama Zofran Lawsuits were filed on June 23 – one in the Southern District of Alabama and the other in the Northern District of Alabama, Southern Division.
In the first complaint, an Alabama mother alleges she was prescribed Zofran for morning sickness early in her first trimester, and later gave birth to a daughter with severe congenital heart defects. The child was forced to undergo open heart surgery, and had a pacemaker — which she will have to live with the rest of her life — installed at the age of 4.
According to the lawsuit, the woman never suspected that Zofran could have been the cause of her daughter’s birth defects until recently, as news of the drug’s dangers has surfaced. The plaintiff claims that GlaxoSmithKline (GSK), the company that makes Zofran, should be held liable for damages related to her daughter’s medical expenses.
The second complaint was filed by another Alabama mother who also used Zofran to treat morning sickness during her first trimester. However, she continued to take the anti-nausea drug as directed into her third trimester. She later gave birth to a son who was immediately diagnosed with multiple congenital malformations, including heart defects.
Plaintiff in the second case also claims she was unaware of the dangers associated with taking Zofran during pregnancy, and that had she known, she never would have used the medication. She seeks to hold GSK liable for her son’s past and future medical expenses.
