What’s the problem?
May 27, 2011 – In a recent legal action taken against Zimmer Inc., the company has been ordered to answer or respond to a number of complaints involving its much troubled Durom cup hip replacement device. The move comes a year after all federal Zimmer hip lawsuits were consolidated as part of a multidistrict litigation (MDL). As a condition of the MDL, an extension of time was granted for responding to complaints and a stay was issued for all outstanding discovery proceedings to ensure that settlement negotiations could continue in individual cases.
Earlier this month, U.S. Magistrate Judge Madeline Cox Arleo allowed parties from the seven non-settling Zimmer Durom cup lawsuits to begin the exchange of information needed to prepare the cases for trial. The parties have also been permitted to proceed with depositions with respect to common issues and case-specific issues in the non-settling cases after June 15, 2011. A status conference has been scheduled for June 29.
Zimmer Hip Side Effects
In 2008, Zimmer Holdings suspended all U.S. sales of the Durom cup due to an abnormally high rate of failure. Hip pain after surgery may be caused by a faulty, loose, or broken implant. The following is a list of side effects that are currently being evaluated for potential Zimmer Durom hip lawsuits:
- unexplained hip pain more than three months after hip replacement
- loosening of the artificial hip implant
- hip replacement revision surgery
When the Zimmer Durom hip cup first entered the market in 2006, it was hailed as an innovation in hip replacement. More than 12,000 patients were implanted with a Zimmer Durom hip replacement device before it was recalled in 2008. Sadly, a high percentage of these patients are now not only facing painful revision surgery and months of rehabilitation, but are also looking for hip implant attorneys to help them obtain the compensation they deserve.
