A Los Angeles Superior Court has ordered Zimmer Holdings Inc. to pay a plaintiff $9.2 million over injuries he suffered after receiving a Durom Cup hip replacement device. The case was the first to go to trial involving complications linked to the Zimmer Durom Cup.

Plaintiff Secures Verdict in Zimmer Hip Lawsuit
The Los Angeles jury found Zimmer liable on claims of failure to warn and defective design of the Durom Cup prior to handing down the $9.2 million judgement. Plaintiff Gary Kline was awarded:
- $153,000 in medical costs;
- $2.4 million for past non-economic damages (including emotional distress and pain) and,
- $6.6 million for future non-economic damages.
What’s the Problem?
Since the Zimmer Durom Cup hit the U.S. market in 2006, thousands of hip replacement patients have been implanted with the device. Unfortunately, hundreds of these people have since come forward alleging debilitating complications that have severely affected their quality of life. Kline’s case was the first of over 2 dozen such lawsuits to reach trial in California Superior Court.
The complaint alleged that Zimmer put profits ahead of consumer safety, while refusing to accept responsibility for releasing a potentially defective medical device into the marketplace. Furthermore, Zimmer misled U.S. surgeons regarding the overall safety of the Durom Cup, which had a good record in Europe.
The American version of the device was different, according to the lawsuit, as it was made with a different type of plasma coating. Rather than testing the safety of the new coating, Zimmer fast-tracked the hip replacement device to market without telling doctors or patients that it was different from its European counterpart.
Durom Cup Left Patient with Permanent Pain, Muscle Damage
According to the lawsuit, Kline suffered from excruciating post-surgery pain and muscle damage, and is barely able to do the most basic physical activities. The only thing that relieves his pain is prednisone, but the drug’s side effects prohibit long-term use.
Like others in need of hip replacement surgery, Kline was swayed by Zimmer’s claims about the Durom Cup – an implant the company marketed as having greater durability and range of motion compared to other hip replacement devices. Instead, the 59-year-old Kline can no longer enjoy the activities he once loved.
