Pharmaceutical giant Bayer has reportedly settled Yaz lawsuits filed on behalf of 651 plaintiffs for approximately $142 million, which averages out to about $218,000 per claim. The news was revealed in the ‘Legal Risks’ section of Bayer’s First Quarter 2012 stockholder’s newsletter, confirming rumors that the company was in the process of resolving some of the Yaz claims. The cases involve a variety of injuries including blood clots, strokes, heart attacks, gallbladder disease, and other potentially life-threatening health complications.
Yaz Lawsuit Update 3/21/13: This week, Bayer Healthcare reportedly agreed to pay out as much as $24 million to settle gallbladder disease lawsuits involving its controversial Yaz and Yasmin birth control pills. Specifically, the company agreed to settlement payments of $2,000 to women who suffered gallbladder injuries, and $3,000 for women’s injuries which were so severe that their gallbladders had to be removed.

What’s the problem?
April 30, 2012 – The new Yaz settlements only involve cases of blood clot injuries such as deep vein thrombosis and pulmonary embolism. Bayer still faces an additional 14,000 lawsuits involving their Yasmin, Ocella and Gianvi birth control pills. The exact number of lawsuits that must be resolved remains unclear, but Bayer has stated that less than half of the plaintiffs suffered blood clot complications.
According to recent estimates:
- approximately 40% of the cases involved a deep vein thrombosis or pulmonary embolism;
- 10% involved heart attacks or strokes;
- 43% involved claims for gallbladder injuries.
The first Yaz trial was scheduled for January 9, 2012, but weeks before it was set to begin, the date was postponed and the parties involved were ordered to begin negotiating settlements. In its stockholder’s newsletter, Bayer reported that it had taken appropriate accounting measures for defense costs and future settlements of Yaz lawsuits.
