What’s the Problem?
April 24, 2017 – The lawsuit was filed on behalf of Plaintiff Joseph Boudreaux, who claims he began taking Xarelto in January 2014 as a treatment for his atrial fibrillation (a-fib). Less than a month later Boudreaux was hospitalized for internal bleeding. His injuries required a week-long stay in an intensive care unit (ICU), numerous blood transfusions and heart procedures, according to the lawsuit.
The complaint alleges that Janssen Pharmaceuticals and Bayer, which jointly developed Xarelto, failed to properly test the medication before bringing it to market, and failed to adequately warn the public and medical community about the potential bleeding risks with the drug.
Bayer argues that Xarelto’s bleeding risks are fully outlined in the medication’s labeling, and well known by prescribing doctors.
“Bayer stands behind the safety and efficacy of Xarelto, and will vigorously defend it,” Bayer spokeswoman Astrid Kranz said in a statement.
Xarelto is prescribed to a-fib patients who are at risk of developing blood clots in the heart, which can travel to the brain and cause a stroke. Xarelto thins the blood and lowers the chance of clots forming.
However, since it was approved by the U.S. Food & Drug Administration (FDA) in 2011, Xarelto has received two “black box” warnings:
• In August 2013, Xarelto received a black box warning indicating that the premature discontinuation of Xarelto increases the risk of thrombotic events and spinal/epidural hematoma in patients.
• In March 2014, Xarelto received another black box warning stating that the optimal timing between the administration of Xarelto and neuraxial procedures in each individual patient is not known.
The thousands of other federal Xarelto lawsuits have been consolidated in a multidistrict litigation (MDL No. 2592) in the Eastern District of Louisiana. The outcomes of the bellwether trials may help determine the value of certain injuries during settlement negotiations.
