The number of lawsuits alleging severe bleeding complications from the blood-thinner drug Xarelto (generic: rivaroxaban) has climbed to approximately 6,600. The complaints have been centralized in a multidistrict litigation (MDL) in the U.S. District Court for the Eastern District of Louisiana.

What’s the Problem?
August 15, 2016 – The first lawsuits filed over Xarelto were filed in early 2014, and the MDL was established in December of that year. The complaints were able to be consolidated because they all alleged similar injuries from the drug such as:
The suits further allege that defendants Bayer AG and Janssen Pharmaceuticals knew or should have known about the risk of these side effects, and failed to adequately warn the public and medical communities.
As part of the MDL, Judge Eldon E. Fallon indicated that a small group of representative cases will be prepared for early trial dates to help gauge how juries are likely to respond to certain evidence and testimony that is likely to be repeated throughout the litigation. These cases, known as “bellwether trials,” are expected to begin in early 2017.
The results of the trials ultimately do not determine what will happen in the other cases in the MDL, they only provide an estimate. The rulings may influence the later trials or they may not. There is no way to predict whether the bellwether trials will result in a Xarelto settlement; however, when one considers the large number of cases filed in the MDL and the fact that these numbers continue to rise, it is likely that the defendant will settle some or all of the cases.
Similar consolidation occurred in lawsuits involving injuries alleged from Pradaxa (generic: dabigatran), the first member of the new generation of blood thinners to hit the U.S. market. Following several years of litigation, the defendants agreed to pay a $680 million settlement to resolve about 4,000 Pradaxa bleeding claims.
