What’s the Problem?
December 6, 2017 – A Philadelphia jury on Tuesday ordered J&J and Bayer to pay $1.8 million in actual damages and $26 million in punitive damages to Plaintiff Lynn Hartman, according to Bloomberg. According to the suit, Hartman claims that she took Xarelto for over a year before being hospitalized in 2014 with gastrointestinal bleeding.
Bayer and J&J emerged victorious in the first 3 bellwether trials to reach federal courts in Louisiana and Mississippi, after juries ruled that Xarelto was safe and the companies adequately warned about bleeding risks associated with the drug.
Plaintiffs were eyeing Philadelphia as a battleground they could beat the healthcare giants, as the venue is known for having plaintiff-friendly juries. They needed a win to keep the other Xarelto lawsuits alive, as bellwether trials are used to gauge how juries are likely to respond to similar allegations.
The defendants vowed to appeal the decision, stating that Xarelto warning labels “have always warned of bleeding events” and provided accurate information to doctors who need to make proper “treatment decisions,” a Janssen spokeswoman told Bloomberg.
Both J&J and Bayer still face more than 20,000 lawsuits from plaintiffs alleging similar injuries from Xarelto.
