Two lawsuits recently filed in New York allege that Bayer HealthCare Pharmaceutical and Johnson & Johnson subsidiary Janssen Pharmaceuticals downplayed risks associated with the blood thinner medication Xarelto (generic: rivaroxaban).

What’s the Problem?
July 12, 2017 – Plaintiffs Thomas Walsh and Joseph Roman took Xarelto and subsequently experienced “life-threatening bleeding” and “other severe and personal injuries,” according to the lawsuits, which were both filed in the Supreme Court of the State of New York.
Walsh and Roman further allege that Bayer and Janssen hid their knowledge of these “serious and dangerous side effects,” including life-threatening bleeding events, which were caused by a lack of adequate clinical trials and studies.
Since it was approved in July 2011, Xarelto has been linked to thousands of adverse event reports and dozens of hemorrhage-related deaths. Bayer and Janssen nonetheless failed to alert the public or conduct additional testing of the drug’s safety, according to the lawsuits.
“Prior to applying for and obtaining approval of Xarelto, defendants knew or should have known that consumption of Xarelto was associated with and/or would cause the induction of life-threatening bleeding, and defendants possessed at least one clinical scientific study, which evidence defendants knew or should have known was a signal that life-threatening bleeding risk needed further testing and studies prior to its introduction to the market,” the court filings said.
Plaintiffs are bringing counts of negligence, strict products liability, breach of warranties, fraudulent misrepresentation, fraudulent concealment, negligent misrepresentation and fraud and deceit, and are seeking compensatory damages.
Both complaints were filed in the Supreme Court of the State of New York, County of New York. The cases are: Thomas Walsh and Cindy Walsh v. Janssen Research & Development LLC et al., case number 156162/2017, and Joseph Roman and Rosa Roman v. Janssen Research & Development LLC et al., case number 156166/2017.
