What’s the Problem?
The Xarelto lawsuit, which was filed on behalf of Nova D. Rose and William H. Rose, alleges that Bayer and Janssen knew or should have known about the drug’s potential to cause severe internal bleeding. A number of other similar complaints have been consolidated into a multidistrict litigation (MDL) in U.S. District Court in Louisiana. Each of the claims in the MDL are related to bleeding episodes allegedly caused by the use of Xarelto.
Xarelto lawsuits allege that the risk of bleeding, and the fact that there is no reversal agent to stop bleeding events once they begin, make the drug unacceptably dangerous. Furthermore, plaintiffs allege they should have been warned of these risks before taking Xarelto, according to the court documents. Plaintiffs are seeking damages for pain, suffering, medical expenses and the loss of loved ones.
The new Xarelto lawsuit was filed in U.S. District Court in the Southern District of West Virginia on December 23, 2014. The case is: Rose et al v. Janssen Research & Development LLC et al, Case number 2:2014cv30672.
