West Fertilizer Co. Carried $1M Liability Policy Prior to Deadly Explosion

The Texas fertilizer plant that exploded last month had only $1 million in liability coverage at the time of the blast, according to The Associated Press. The tragedy claimed the lives of 14 people and caused tens of millions of dollars in damage to the area surrounding the facility. The plant’s owner is expected to ask a judge to divide the $1 million among plaintiffs filing lawsuits and then declare bankruptcy.

What’s the Problem?

The recent news that the West Fertilizer Co. was only carrying $1 million in liability insurance at the time of the explosion seems to be consistent with the plant’s overall lack of responsibility thus far. Since the April 17th blast, the company has yet to take accountability for its part in the tragedy, which killed 14 people and seriously injured nearly 200 others. The tiny size of the insurance policy was due in part to the fact that Texas does not require coverage for hazardous activities, and conducts very little oversight or regulation of such operations.

The cause of last month’s explosion is still under investigation, but there is no evidence to suggest that foul play was involved. Authorities are looking into dozens of leads, including a call to an arson hotline and a tip that there had been a fire at the plant earlier on the day of the blast. Investigators from numerous state and federal agencies are contributing to the investigation, and hope to determine the cause of the explosion by May 10.
