Lawsuits Follow Chipotle Norovirus Outbreak in Virginia

What’s the Problem?

August 3, 2017 – Plaintiffs Kyle Hogan and Patrick Moore claim they got sick after eating at the Chipotle in Sterling, Virginia, on or around July 14, according to NBC Washington. This is the same restaurant where more than 130 people reported falling severely ill last month.

Chipotle says the outbreak was likely caused by a sick employee, not contaminated food. CEO Steve Ells said on a conference call that an internal investigation into the illnesses found that the Sterling location was not adhering to cleaning protocols when the outbreak occurred.

“Based on symptoms reported and these preliminary laboratory results, the cause of the outbreak is believed to be norovirus, though the specific source of the norovirus has not yet been identified,” said Dr. David Goodfriend, director of the Loudoun County Health Department.

A spokesperson for Chipotle said the Sterling restaurant was thoroughly sanitized and the staff was retrained on cleaning protocol. Executives said earlier this week that they will henceforth be enforcing a “zero tolerance” policy for employees who fail to properly follow food safety procedures.

Hogan and Moore are seeking damages in excess of $74,000 for pain and suffering, mental anguish, physical impairment, loss of quality of life, medical expenses, travel expenses, emotional distress, lost wages, punitive and/or exemplary damages, and attorneys’ fees.
