Woman Paralyzed in Uber Accident Awarded $38 Million

A Texas jury has awarded more than $37 million to a woman who sued Honda after being paralyzed in a 2015 car crash in which her Uber driver ran a red light and was T-boned by an oncoming pickup truck.

February 18, 2019 – Plaintiff Sarah Milburn filed the lawsuit against Honda over the seatbelts in its Odyssey minivan, which she claimed were poorly designed and contributed to her catastrophic injuries. The crash severed Milburn’s spine, leaving her a quadriplegic, according to the suit.

What’s the problem?

According to the lawsuit, Milburn was riding in the middle seat of the third row of a 2011 Honda Odyssey driven by Uber driver, Arian Yusufzai. The seatbelt Milburn was using was an unfamiliar 2-part system which she was unable to fasten correctly.

Yusufzai ran a red light while speeding, and and the Odyssey was struck by a Ford F-150 pickup. The seatbelt failed to restrain her during the crash, allowing her head to fly forward into the seat in front of her, causing severe head and neck injuries, according to the lawsuit.

The jury awarded Milburn $37.6 million in damages, including nearly $20 million in medical expenses. Honda was ruled to be 63% responsible for her injuries, Yusufzai was 32% responsible, and Milburn was 5% responsible for not connecting the seatbelt properly.

A Honda spokesperson said Friday that the automaker will appeal the decision. The company argued it wasn’t responsible for Milburn’s injuries because the Odyssey’s seatbelts met federal safety standards.

The lawsuit is In RE: Sarah Milburn v. American Honda Motor Co. Inc. — Case No. DC-16-16470 in the 116th Civil District Court in Dallas County, Texas.
