Update: New York Uber Driver Killed in DWI Crash on Long Island
June 21, 2017 – A man from Queens, NY, has admitted to killing an Uber driver last year while driving drunk on the Long Island Expressway (LIE), in a wreck that threw the victim into traffic before another vehicle dragged him a half-mile to his death. Prosecutors said Bonifacio Enriquez, 36, of College Point, New York, pleaded guilty in Nassau County Court to second-degree manslaughter and driving while intoxicated.
What is Uber?
Uber is a rideshare enterprise that started in San Francisco and in less than 5 years has spread across the globe. The company is popular because it’s convenient and cheap – users can request a ride on a smartphone app, the car goes straight to their location, and the prices are lower than taxis.
What’s the Problem?
Uber’s business model has gotten a lot of scrutiny from regulators and pushback from the taxi industry. It also brings up some unique legal questions. If you’re hurt in a car crash while riding in an Uber, for example, what happens?
Accidents Where the Uber Driver is Not at Fault
If the driver was not at fault for the accident, he or she will first have to file a claim against the insurance of the other driver. In many cases, however, the at-fault driver will not have insurance or the insurance coverage limit is not enough to provide for full compensation for the injured victim. In such cases, a passenger will then have an Uninsured Motorist (UM) or an Underinsured Motorist (UIM) claim against the rideshare companies’ insurance.
What is the Compensation for Injured Passengers?
Victims of personal injury have the right to seek financial recovery for all damages suffered. A calculation of recovery is based on the following factors:
- The extent and severity of the injuries suffered.
- Past and anticipated future medical expenses.
- Other economic damages – damage to property, loss of income and future loss of earning.
- Level of non-economic damages, including emotional distress and pain and suffering compensation.
- Whether punitive damages can be assessed.
Can I Participate in a Class Action?
Our lawyers have decided against the filing of a class action lawsuit in the Uber accident litigation, and are currently only filing individual complaints on behalf of injured parties. Contact our lawyers now to learn more about your legal rights.
