Trinity Highway Products LLC has announced that it will stop shipping its ET-Plus guardrails over concerns that the devices can fail and impale drivers in the event of a crash. The announcement comes less than a week after a Texas jury found Trinity guilty of defrauding the U.S. government by selling dangerous guardrails to the Federal Highway Administration (FHWA).

What’s the Problem?
October 24, 2014 – According to Law 360, the FHWA has ordered Trinity to preform additional crash testing of its guardrail systems after they reportedly failed in over 100 accidents, killing and injuring motorists.
“In light of FHWA’s request, the right thing to do is to stop shipping the product until the additional testing has been completed,” said Trinity President Gregg Mitchell.
On October 20, a federal jury sided with whistleblower Joshua Harman, who accused Trinity of changing the design of its ET-Plus guardrail end terminal without informing the FHWA. Harman said the company misrepresented the modified design as identical to the approved version when in reality it was far more dangerous.
After Trinity altered the end terminal in 2005, it had the tendency to “throat lock” during crashes, which causes the guardrail system “to double over on itself or protrude through the crashing vehicle.”
“If the guardrail and head assembly protrude like a spear through the vehicle, the inevitable result is usually death or serious bodily injury to the persons in the vehicle,” the lawsuit said.
