What’s the Problem?
June 19, 2015 – Joshua Harman, a competitor of Trinity’s, sued the company on behalf of the U.S. government and will receive $199 million plus attorney fees, according to NBC News.
Last October, a Texas jury ruled that Trinity defrauded the federal government by failing to disclose design changes the company made to its ET-Plus guardrails, which, according to Harman, made the devices lock up on impact rather than ribboning out an absorbing the impact of a crash. Trinity maintains their guardrails are safe.
Jurors said the company should pay at least $175 million. U.S. District Court Judge Rodney Gilstrap ordered both sides into mediation; however, the parties failed to reach a settlement. On Tuesday, Gilstrap tripled the award and added $138 million in penalties for false claims.
