Transvaginal Mesh Lawsuit Filed in Kentucky

What’s the Problem?

August 17, 2016 – Attorney General Andy Beshear is accusing J&J of concealing and misrepresenting to the public and medical communities many of the potential health risks with vaginal mesh, according to FOX News. The devices are used to treat pelvic organ prolapse (POP), a condition that occurs due to the shifting of internal organs after childbirth, a hysterectomy or menopause.

“The way this company clearly chose profits over people is outrageous,” Beshear said. “My office has talked to victims whose lives have been devastated by this company’s deceitful practices. We may not be able to give them back the lives they once had, but my office will do everything we can to hold this company accountable.”

In January, the U.S. Food & Drug Administration (FDA) reclassified transvaginal mesh slings from class II, which includes moderate-risk devices, to class III, which includes high-risk devices. The agency also announced new federal scrutiny that requires manufacturers to submit a premarket approval (PMA) application to support the safety and effectiveness of surgical mesh for the transvaginal repair of POP.

Beshear said that over 15,000 women in Kentucky received transvaginal mesh without being adequately warned about problems that can potentially lead to permanent disability. The complaint seeks civil penalties of $2,000 per violation of the state’s deceptive practices law, and $10,000 when targeted to consumers over the age of 60.
