All of the lawsuits were filed on behalf of women who allegedly developed complications such as chronic pain, mesh erosion, pain during sex (dyspareunia) and recurrence of urinary problems after being implanted with vaginal mesh.

What’s the Problem?
In early 2014, the first Ethicon bellwether trial, which involved a product liability lawsuit filed on behalf of Carolyn Lewis, ended in a defense verdict after Judge Joseph Goodwin entered judgment as a matter of law following the plaintiff’s case. Goodwin determined that Lewis failed to present sufficient evidence that the Ethicon mesh device was defectively designed or caused her injury. Then in Sep. 2014, a second bellwether trial involving an Ethicon bladder sling ended in a $3.25 million verdict for the plaintiff.
A third and final Ethicon bellwether trial was set to begin in Dec. 2014, but was postponed till March 2015. Allegations raised in the complaint are typical of other claims, alleging that the plaintiff suffered a long list of injuries after being implanted with an Ethicon Gynecare Prolift Vaginal Mesh device. As a result of her injuries, the plaintiff allegedly had to undergo at least 4 operations to have the mesh removed.
