What’s the Problem?

December 20, 2016 – According to the lawsuit, Mary Ann Witherspoon was diagnosed with ovarian cancer in June 2014, and died from the disease that November. Mary’s husband Marcus is blaming the death on her prolonged exposure to Johnson & Johnson’s talcum powder products.

Plaintiff alleges that J&J negligently marketed its Baby Powder and Shower-to-Shower body powder as safe to use by women, failing to warn consumers of the cancer risk posed by the products.

Johnson & Johnson has recently suffered 3 costly defeats in the talcum powder litigation. In October, a St. Louis jury awarded $70 million to Deborah Giannecchini, who was diagnosed with stage IV ovarian cancer after years of using Johnson’s Baby Powder for feminine hygiene. In February, the family of a woman who died from the disease was awarded $72 million, and in May, another plaintiff prevailed against the company, obtaining a $55 million award.

The U.S. Judicial Panel on Multidistrict Litigation (JPML) in October consolidated 9 Johnson & Johnson talcum powder lawsuits in New Jersey federal court for pretrial handling. Plaintiffs are accusing J&J of personal injury or wrongful death over the side effects. The common questions among the complaints are whether the talc-based powders cause ovarian or uterine cancer, whether the company knew about the correlation and whether it did enough to warn consumers.

In the Texas lawsuit, Witherspoon is seeking a jury trial, compensatory damages in excess of $75,000, economic and punitive damages, pre- and post-judgment interest, attorney fees, court costs and any other damages the court deems fit.
