What’s the Problem?
June 23, 2017 – According to the lawsuit, Plaintiff underwent hernia repair surgery with a Physiomesh patch in September 2013. Less than a year later, she ended up back in the hospital to treat complications from the hernia mesh, according to the complaint.
The surgeon who operated on the patient allegedly found “numerous balled-up, rolled-up, and incorporated [Physio]mesh,” all of which had to be taken out “with difficulty using cautery and sharp dissection.”
Johnson & Johnson’s Ethicon unit in May 2016 withdrew its Physiomesh Flexible Composite Mesh in the U.S. after an independent analysis of 2 large studies in Germany and Denmark found a higher risk of hernia recurrence and reoperation after laparoscopic ventral hernia repair with the product.
Plaintiff states that she continues to suffer from pain and other adverse health complications even after undergoing hernia revision surgery. She blames J&J for manufacturing and marketing an allegedly defective product that was neither safe nor effective.
The case was filed in the U.S. District Court for the Southern District of Texas. Plaintiffs are seeking in excess of $75,000 in damages.
A motion has been filed to consolidate all federal Physiomesh hernia patch lawsuits into a multidistrict litigation (MDL) for pretrial handling. MDLs are common in complex medical device litigation in which multiple lawsuits alleging similar injuries are filed against the same defendant. Centralization is intended to reduce discovery, eliminate conflicting rulings by different judges, and to expedite the litigation process for all parties.
