What’s the Problem?

Lawyers investigating potential West, Texas fertilizer plant explosion lawsuits will likely be casting a wide net of ‘mass action’ claims, not just seeking to represent the immediate victims of the blast, but also for hearing loss and trauma for residents, farm animals, pets and property in the area surrounding West, Texas. Plaintiffs could potentially include residents of the small towns and rural areas surrounding West, plus travelers along Interstate 35 that lies along the western edge of the small farming community.

The starting point for law firm investigators will be the West Fertilizer Company where least week’s blast took place. It now seems possible that the casualties caused by the event could surpass the 2005 BP Texas City refinery explosion that killed 15 workers and injured 100 others. Although figures are still coming in, it has been estimated that the fertilizer plant explosion claimed the lives of at least 14 and injured more than 200. BP set aside $1.5 billion to settle lawsuits and pay fines for that tragedy, a figure that West Fertilizer Co. won’t even be able to come close to. Last year, BP reported $237 billion in sales, compared to a paltry $4 million for West.

While investigating the source of the explosion, lawyers may look into manufacturing defects and storage guidelines for trademarked products housed at the facility. These lines of investigation could potentially expose national chemical companies to claims, and could land lawsuits in federal court, rather than state jurisdictions. Additionally, if investigators determine that trucks, train or pipeline transport played a role in the tragedy, plaintiffs’ lawyers may pursue the railroad company that delivers ammonium nitrate to the plant.
