What’s the Problem?
December 8, 2016 – According to the lawsuit, Plaintiff Connie Shatswell was diagnosed with breast cancer in 2010. After undergoing chemotherapy with Taxotere, she beat her diagnosis and has lived cancer-free ever since.
However, Shatswell’s life has not completely returned to normal, as her hair never grew back following cancer treatment. She knew temporary hair loss was a potential side effect of chemo, but had no idea or warning it could be permanent.
“I never was a girly girl,” she said. “My hair was the one thing I knew could make me look more like a girl.”
Five years before Shatswell was treated with Taxotere, Sanofi-Aventis conducted its own study and found that Taxotere caused about 9% of patients to lose hair permanently. The company issued a warning to patients in other countries; however, no such warning accompanied the drug in the U.S. until last year.
Shatswell claims that Sanofi’s failure to warn has cost her dearly, and would like to see the company punished appropriately. Her complaint cites damages including breach of implied warranty, failure to warn, fraud, negligence and products liability. She is seeking a jury trial and special damages, treble damages, expert witness fees, all legal fees and interest, and any other relief the court deems just.
In October, The U.S. Judicial Panel on Multidistrict Litigation (JPML) ordered that all federal lawsuits alleging permanent hair loss or “alopecia” from Taxotere to be consolidated into a multidistrict litigation (MDL No. 2740) for pretrial handling in the Eastern District of Louisiana. At the time of the ruling, at least 33 such complaints were pending in 16 different states.
