A Mississippi woman who allegedly suffered permanent hair loss after undergoing chemotherapy treatment with Taxotere (generic: docetaxel) has filed a products liability lawsuit against Sanofi Aventis.

What’s the Problem?
June 17, 2016 – According to the lawsuit (PDF), Plaintiff Christine Tolefree was diagnosed with cancer in her right breast in May 2014. She underwent chemo with Taxotere and upon completing treatment, her hair did not grow back. Tolefree claims her doctor never warned her that permanent hair loss or “alopecia” was a potential side effect of the drug, and she continues to suffer from disfiguring baldness, according to the suit.
More than 30,000 women in the U.S. are diagnosed with breast cancer annually, and Taxotere is the most frequently prescribed chemotherapy medication used to treat the disease. Temporary hair loss is a common side effect of chemo drugs; however, long-term or permanent alopecia is a risk that is unique to Taxotere.
Tolefree, like dozens of other breast cancer survivors across the U.S. who were treated with Taxotere, claims that is Sanofi responsible for “serious and dangerous side effects, severe and personal injuries that are permanent and lasting in nature, and economic and non-economic damages, harms and losses.”
Plaintiff alleges Sanofi failed to adequately warn about the risk of Taxotere side effects, and that the drugmaker did not “conduct adequate testing, including pre-clinical and clinical testing and post-marketing surveillance to determine the safety, dangers and risks associated with docetaxel (Taxotere).”
The complaint — Tolefree v. Sanofi-Aventis — was filed on June 2 in the U.S. District Court for the Southern District of Mississippi under case number 3:16-cv-00412. Tolefree is seeking a jury trial and damages including past and future medical expenses, psychological counseling / therapy expenses, loss of earnings and loss of earning capacity.
