Taxotere Alopecia Lawsuit Filed in Louisiana

A Louisiana woman who allegedly suffered permanent alopecia (hair loss) from chemotherapy with Taxotere has filed a lawsuit against the drugmakers.

A Louisiana woman has filed a products liability lawsuit against Sanofi-Aventis alleging that the chemotherapy drug Taxotere (generic: docetaxel) caused her to suffer permanent hair loss, a condition known as “alopecia”.

What’s the Problem?

July 7, 2016 – According to the lawsuit, plaintiff was diagnosed with infiltrating ductal carcinoma in early 2010 and started chemo with Taxotere in September of that year. She underwent a total of 4 rounds of treatment with the drug, but was never told that permanent hair loss could result, according to the complaint.

Plaintiff alleges that Sanofi failed to warn about the link between Taxotere and alopecia, and provided patients and doctors with misleading information about the possibility of hair regrowth. The manufacturer is also accused of failing to label its U.S. products with the same hair loss warnings that are used in other countries. This occurred, according to the lawsuit, despite recent studies which highlighted the potential risks, including those published in the Annals of Oncology and the American Journal of Dermatopathology, as well as another that was presented in 2014 at the National Cancer Conference.

Furthermore, plaintiff alleges that Sanofi failed to adequately warn patients that they may not regrow their hair once chemotherapy with Taxotere is complete, all the while similar treatments are available that do not come with the risk of permanent alopecia. The complaint is proceeding under several causes of action including liability under the Louisiana Products Liability Act, defective design, failure to warn, breach of express warranty and breach of warranty in redhibition. Plaintiff is seeking a damage award that includes compensation for the price paid for Taxotere, medical expenses, loss of enjoyment of life, mental anguish / distress, attorney fees, costs and other losses.
