What’s the Problem?
July 19, 2017 – MDL No. 2740 now includes at least 1,272 Taxotere lawsuits, which are pending before Judge Kurt D. Engelhardt in the Eastern District of Louisiana, according to an update issued Monday by the U.S. Judicial Panel on Multidistrict Litigation (JPML).
Engelhardt in December appointed a Plaintiffs’ Steering Committee and Executive Committee in order to “facilitate efficient management of the Plaintiffs’ case.”
The main task of the Plaintiffs’ Steering Committee (PSC) is to look at evidence that will answer common questions of fact and allegations that are central to each lawsuit. PSC supervises and directs the efforts of numerous lawyers and paralegals, who will be tasked with reviewing internal corporate documents, questioning witnesses in depositions, and drafting various briefs.
Throughout the process, PSC guides the litigation toward potential trials, hoping to build the best case for plaintiffs. The Executive Committee’s 4 members will coordinate and oversee duties carried out by the PSC, along with scheduling meetings for both committees.
Bellwether trials in the federal Taxotere litigation are scheduled to begin in September 2018, according to the Louisiana Record. These trials are common in large, complex litigation, and often involve lawsuits representative of other cases pending in the proceedings. They are intended to gauge the strength of plaintiffs’ claims, and often provide insight into how juries might react to similar questions of fact.
