Taxotere Alopecia Lawsuits Centralized in Louisiana

The U.S. Judicial Panel on Multidistrict Litigation (JPML) has ordered all federal lawsuits alleging permanent hair loss or ”alopecia” from the chemotherapy drug Taxotere (generic: docetaxel) to be consolidated into a multidistrict litigation (MDL) in Louisiana district court for pretrial handling.

What’s the Problem?

October 6, 2016 – At least 33 federal lawsuits pending in 16 states are accusing Sanofi-Aventis of marketing Taxotere as superior to other chemo treatments, despite having knowledge that it could cause permanent hair loss, according to Law360.

According to one of the complaints, filed on behalf of Ami Dodson in California, the scheme began in 1996, the year Taxotere was approved by the FDA. First, Sanofi coached its employees to misrepresent the safety and effectiveness of Taxotere’s “off-label” use to expand its market, and then paid kickbacks to healthcare providers to persuade them to prescribe the drug for unapproved indications, according to Dodson.

As a direct result of these actions, sales of Taxotere grew from $424 million in 2000 to $1.4 billion in 2004.

“Defendants [preyed] on one of the most vulnerable groups of individuals at the most difficult time in their lives,” Dodson’s complaint read. “Defendants obtained billions of dollars in increased revenues at the expense of unwary cancer victims simply hoping to survive their condition and return to a normal life.”

Although temporary hair loss is a common side effect of chemotherapy, permanent alopecia is not, and although Sanofi knew or should have known that Taxotere’s risk of this complication was far greater than with other widely-available alternative drugs, the company still misled the public and medical community about whether hair would grow back.
