What’s the Problem?
July 18, 2016 - According to the lawsuit, Plaintiff Barbara Ross was diagnosed with ovarian cancer in 2014 when she was just 39-years-old. Ross claims her decades-long use of the talc-based Johnson’s Baby Powder and Shower-to-Shower Body Powder caused her to develop the disease, which required the removal of both her ovaries and fallopian tubes to treat.
Plaintiff alleges that Johnson & Johnson knew or should have known about the potential health risks of using its talcum powder products, yet failed to place warnings on the products. Plaintiff further contends that the company engaged in deceptive and fraudulent marketing despite numerous studies (the first of which date back to the early 1970s) linking talcum powder to an increased risk of ovarian cancer and uterine cancer.
The complaint was filed in the U.S. District Court for the Northern District of Illinois. Ross is seeking a jury trial, as well as both compensatory and punitive damages.
Last week, a motion was filed to consolidate all talcum powder lawsuits into a multidistrict litigation (MDL) for pretrial handling. Based on the numerous complaints filed against J&J alleging similar injuries from its talc-based products, the motion seeks to consolidate the cases to promote efficiency by deciding issues of law and fact that are common to all plaintiffs.
