What’s the problem?
April 11, 2018 – The jury awarded $55 million in punitive damages against J&J and $25 million against Imerys, according to Law360. Lawyers for the plaintiff demanded jurors send a clear message that selling baby powder and other cosmetic products which contain asbestos is wrong and will not be tolerated.
The jury heard the message loud and clear, in what goes down as the first ever decision in favor of a plaintiff alleging cancer from a talcum powder product. Many feel the ruling will turn the tide in favor of more plaintiffs in these cases. J&J still faces approximately 5,500 lawsuits over its Johnson’s Baby Powder and Shower-to-Shower.
Plaintiffs in the cases all make similar allegations that use of talc-based products caused them to develop cancer. The complaints further allege that J&J and its talc suppliers knew their products caused cancer, but failed to provide warning labels or issue recalls for their products.
Defendants claim that studies linking talc to cancer are based on discredited research, and they note that numerous regulatory agencies have decided against requiring warnings on talc-containing products.
