What’s the Problem?
On Dec. 29, 2014, more than 160 Syngenta corn lawsuits were transferred to the newly-created multidistrict litigation (MDL) in Kansas, adding to the 9 original Viptera corn lawsuits. Farms and other agricultural entities from over 15 U.S. states that have filed complaints against Syngenta are now part of the MDL in Kansas, according to court documents.
It was announced on Dec. 18 that China had finally approved Syngenta’s MIR 162, commonly known as Agrisure Viptera, a genetically-modified corn seed engineered to be herbicide resistant, or “Roundup Ready.” Lawsuits allege that farms and commodity traders suffered economic losses as a result of Syngenta’s introduction of MIR 162 to the U.S. market prior to Chinas approval of the seed.
According to a transfer order dated Dec. 11, Syngenta’s Viptera corn seeds entered U.S. stocks prior to being approved for import by the Chinese government, which had imposed a complete ban on U.S. corn with this trait. Plaintiffs are corn growers and grain exporters who suffered economic losses resulting from China’s ban on MIR162 corn. All actions involve common factual questions regarding Syngenta’s decision to commercialize Viptera corn seed in the absence of Chinese approval.
