Last week, a Florida woman filed a product liability claim against the company in New Jersey Superior Court, alleging that problems with the Rejuvenate caused the device to fail just a few short years after being implanted. The lawsuit states that the plaintiff was forced to undergo painful revision surgery to have the Rejuvenate removed, during which one of her femurs broke, resulting in a number of adverse complications.

What’s the problem?
According to the new Stryker hip replacement lawsuit, which was filed August 8 on behalf of 66-year-old Dianne Pingel in Bergen County, New Jersey, the plaintiff was implanted with two artificial hips that used the Stryker Rejuvenate modular neck stems, which feature two components that make up the femoral portion of the device. Unlike older hip implants, which feature a single piece that makes up the femoral stem and neck, the Rejuvenate features two pieces that fit inside each other, allowing the surgeon to adjust the length to match the patient’s height.
Shortly after surgery, the two metal components of Pingel’s Rejuvenate modular neck stem rubbed together during routine daily activities, releasing small metal debris that resulted in metal ion poisoning (a condition known as metallosis).
The complaint alleges that Pingel had to undergo painful revision surgery to correct the issue, during which one of her femurs broke. She later dislocated her hip, suffered another broken femur, and is now in a nursing home awaiting more surgeries. Pingel’s lawsuit claims that the procedures were complicated by pseudotumors, bone necrosis, and other soft tissue side effects that have been connected to metallosis.
Last month, Stryker issued a nationwide recall for the Rejuvenate modular-neck hip stem components, due to reports of fretting and corrosion at the modular neck junction. The company indicated that the device has been linked to pain, swelling, local tissue reactions and early failure of the implant.
The Stryker Rejuvenate Modular Hip System was approved by the U.S. Food & Drug Administration (FDA) in February 2009. While such devices are typically designed to last between 15 and 20 years, the Rejuvenate was pulled off the market less than two years after it was first introduced.
Pingel’s lawsuit is seeking compensatory damages for medical expenses and pharmaceutical costs, as well as for punitive damages. Industry insiders expect that a large number of similar Stryker Rejuvenate lawsuits will be filed in the near future, as the hip implants were widely used in their short time on the market.
